Child Relocation Cases

The Family Law Section of the American Bar Association is meeting in Washington, DC this week. The morning session was all about cases where one parent wanted to relocate with the children.

The states are all over the ball park on this issue but the trend seems to be to be flexible and examine each case as it comes with its own set of facts.

The court cannot keep the parent from moving, but it can change custody to keep the children from moving. Therefore, relocation cases are really custody cases.

The main thing to do is keep your focus on the child and how the move will help or harm the child. Try to negotiate a resolution first. If you must go to court, ask the court to appoint a lawyer for the child.

If you are a father opposing relocation of the mother and children, you need to be consistent with visitation and participate in parenting in a helpful way.
